Terms of Service

By creating an account or using any of OUR PRODUCTS, you are agreeing to these Terms of Service (“Terms”). Violation of these terms may, at our discretion, result in US terminating your account. We’ve written them in plain English because we think you should actually understand what you’re agreeing to.
We may update these Terms at any time. If we make significant changes, we will refresh the date at the top of this page and notify you by email or with a notice in the app at least 14 days before the changes take effect. Continued use of OUR PRODUCTS after that point means you accept the updated terms.
Definitions
- IT’S US STUDIO, US, we, our, or the Company refers to IT’S US STUDIO, the company behind Workbench.
- OUR PRODUCTS or Services refers to our website, useworkbench.ca, and any product created and maintained by IT’S US STUDIO, whether delivered within a web browser, desktop application, mobile application, or another format (including but not limited to Workbench).
- You or your refers to the person or organization that owns an account with one or more of OUR PRODUCTS.
Account terms
- You are responsible for maintaining the security of your account and password and for ensuring that any of your users do the same. IT’S US STUDIO cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. We recommend all users set up two-factor authentication for added security where available.
- You need to be at least 18 years old and able to enter into a binding agreement to use OUR PRODUCTS. If you’re using them on behalf of a business, you represent that you have the authority to bind that business to these Terms.
- You are responsible for all content posted to and activity that occurs under your account, including content posted by and activity of any users in your account.
- You must be a human. Accounts registered by bots or other automated methods are not permitted.
Acceptable use
You agree not to use OUR PRODUCTS to:
- Violate any applicable law or regulation
- Attempt to gain unauthorized access to our systems or another user’s account
- Reverse engineer, decompile, or attempt to extract the source code of the application
- Resell, sublicense, or provide access to OUR PRODUCTS to third parties as a service
- Scrape, crawl, or extract data from OUR PRODUCTS through automated means
- Transmit malware, spam, or any content that is harmful, offensive, or fraudulent
Fair use of notifications
Workbench includes unlimited SMS and email notifications as part of every plan. We offer this because we believe it makes your shop run better and your customers happier — and we want you to use it.
That said, unlimited means unlimited for your legitimate business operations, not unlimited in a way that abuses the infrastructure we pay for on your behalf.
Fair use means:
- Sending notifications that are directly related to a customer’s repair job (status updates, ready for pickup, follow-ups)
- Communicating with real customers who have given you their contact information
- Normal shop volumes — a shop processing dozens or hundreds of jobs per month
It does not mean:
- Bulk marketing campaigns or promotional blasts
- Sending repeated or unsolicited messages to people who haven’t opted in
- Programmatic or automated message generation beyond normal job workflows
- Any use designed to circumvent messaging platform limits or policies
If we see usage that looks abusive or out of proportion with normal shop operations, we’ll reach out first. We won’t cut you off without a conversation. But we reserve the right to limit or suspend notification sending if the usage is clearly outside the spirit of what the plan is for.
Payment, refunds, and plan changes
- Payments are processed by Stripe. By subscribing to OUR PRODUCTS, you agree to pay the applicable subscription fees.
- New accounts start with a 30-day free trial with full access to all features, no credit card required. After the trial period, you need to pay in advance to keep using the Service. If you do not pay, your account will enter a locked state — your data is preserved but the app is inaccessible. After 30 days in a locked state, your account and all associated data is permanently deleted.
- If you switch from a monthly plan to an annual plan, we will charge your card immediately for the full annual amount and your new billing cycle starts on the day of the switch. If you switch from an annual plan to a monthly plan, the change takes effect at the end of your current annual billing period. For all other plan level changes, the new rate starts from the next billing cycle.
- All fees include all taxes, levies, or duties imposed by taxing authorities. Where required, we will collect those taxes on behalf of the taxing authority and remit them accordingly. Otherwise, you are responsible for payment of all taxes, levies, or duties.
- We offer a 30-day no-questions-asked refund policy. If you’re not satisfied with OUR PRODUCTS for any reason within your first 30 days, you can request a full refund and we’ll process it promptly.
Cancellation and termination
- You are solely responsible for properly cancelling your account through your account settings. An email or support request to cancel your account is not automatically considered cancellation. If you need help, contact US at support@useworkbench.ca.
- If you cancel the Service before the end of your current paid period, your cancellation will take effect at the end of that billing period and you will not be charged again. We do not automatically prorate unused time in the last billing cycle.
- Upon cancellation, your account enters a 30-day grace period where your data is preserved but the app is inaccessible. After 30 days, all content is permanently deleted from active systems. After 60 days, all content is permanently deleted from our backups. We cannot recover this information once it has been permanently deleted.
- We reserve the right to suspend or terminate your account and refuse any and all current or future use of OUR PRODUCTS at any time. Suspension means you and any users on your account will not be able to access the account or any content in it. Termination will furthermore result in the deletion of your account and all associated content.
- If we terminate your account without cause, we will refund any prepaid time remaining on your subscription.
- Verbal, physical, written, or other abuse (including threats of abuse or retribution) directed at a Company employee or officer will result in immediate account termination.
Modifications to the service and prices
- We reserve the right at any time to modify or discontinue, temporarily or permanently, any part of OUR PRODUCTS with or without notice.
- If we significantly change pricing, we will give at least 30 days’ notice and will notify you via the email address on record before the new pricing takes effect on your account.
Uptime, security, and privacy
- Your use of OUR PRODUCTS is at your sole risk. We provide the Services on an “as is” and “as available” basis. We do not offer service-level agreements but take uptime seriously.
- We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other customers. We’ll reach out before taking any action, except in rare cases where the level of use may negatively impact performance for other customers.
- We take many measures to protect and secure your data through backups, redundancies, and encryption. All data is encrypted in transit via SSL/TLS.
- You agree that IT’S US STUDIO may process your data as described in our Privacy Policy and for no other purpose. On rare occasions, our staff may access your data to help with support requests (with your express consent), to fix errors in automated processing, to safeguard OUR PRODUCTS and investigate potential abuse, or to the extent required by applicable law.
Your data
Any data you create in OUR PRODUCTS belongs to you. We don’t sell it, share it, or use it for anything other than providing you the service.
You are responsible for the data you enter into OUR PRODUCTS, including your customers’ personal information. You represent that you have the right to collect and store that data, and that you’re doing so in accordance with applicable privacy laws.

Copyright and content ownership
- All content posted within OUR PRODUCTS must comply with applicable copyright law.
- You give US a limited license to use the content posted by you and your users in order to provide the Services to you, but we claim no ownership rights over those materials. All materials you submit to OUR PRODUCTS remain yours.
- We do not pre-screen content, but we reserve the right in our sole discretion to refuse or remove any content that is available via OUR PRODUCTS.
- IT’S US STUDIO or its licensors own all right, title, and interest in and to OUR PRODUCTS, including all intellectual property rights. You obtain no ownership rights in OUR PRODUCTS as a result of your use. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without express written permission from IT’S US STUDIO.
Liability
You agree that IT’S US STUDIO is not liable to you or to any third party for damages of any kind that result from the use of OUR PRODUCTS, the inability to access data, or unauthorized access to your data or account. IT’S US STUDIO is also not liable for damages of any kind related to actions of any third party that uses OUR PRODUCTS, or any other consequences related to these Terms or OUR PRODUCTS.
To the extent liability cannot be fully excluded under applicable law, our total liability to you for any claim arising from these Terms or your use of OUR PRODUCTS is limited to the amount you paid US in the 12 months prior to the event giving rise to the claim.
Indemnification
You agree to indemnify and hold IT’S US STUDIO harmless from any claims, losses, or damages (including legal fees) arising from your use of OUR PRODUCTS, your violation of these Terms, or your violation of any third party’s rights.
Governing law
These Terms shall be governed by and construed in accordance with the laws of Canada. Any disputes will be resolved under Canadian law. We’ll always try to resolve things directly and reasonably before either of us considers formal legal action.
